The sale of the family home in a divorce is fairly common. But things don’t always go smoothly.

We represented the ex-wife in a case where the parties had been divorced for six years. The divorce decree (drafted by a prior attorney) stated that they would continue to own the family home and would reside there together “for some period” after the divorce.

Six years later, they were still living in the family home together and the husband refused to put the home up for sale. The situation was growing very uncomfortable for the ex-wife. The ex-wife was at a loss on how to get her money out of the house so she could move.

Our firm stepped in, hired a real estate appraiser to value the residence and developed an argument as to why it was time for the parties to sell and move on. This allowed us to negotiate a settlement with the husband whereby he bought out the wife’s interest in the home.
