Many people are talking about a recent national news story regarding Alaina Giordano, a mother of two who is battling against Stage 4 breast cancer. This week, a judge decided that Giordano’s two children, ages five and eleven, should move over 1,000 miles to live with their father. The child custody case has many wondering how judges decide what is truly in the
best interest of the child. In the case, the judge explained that the children needed the stable home and good schools that the employed father, Kane Snyder, has set up in Chicago. On the other hand, the courts said, living with a sick and unemployed mother may not be the healthiest choice for the kids. Giordano could have joint custody of the children if she moved to Chicago, but says that she can’t leave the family and support that she has now.
Those familiar with the
divorce and child custody case say that the decision is more complicated than just the fact that the mother has breast cancer – the divorce involved domestic violence and the judge had some concerns about the life the children would have with the mother apart from her health issues.
This child custody case is an extreme but good example of how
complicated child custody disputes can be and of how different one case can be from another. If you are involved in a child custody dispute and require an attorney, contact Molly Kenny today for more information.
